WHEREAS there has been duly filed with this Court an affidavit by County Attorney, County, Montana, showing that unlawful activity has occurred, that said County Attorney has a duty to investigate said alleged unlawful activity, and requesting the issuance of investigative subpoenas therein, and;

WHEREAS it appears upon the affidavit of the County Attorney that the interests of justice requires the issuance of said investigative subpoenas.

NOW, THEREFORE, IT IS ORDERED that the Clerk of the District Court in and for the County of , State of Montana, shall forthwith issue investigativesubpoenas to the following person(s) commanding them to appear before the County Attorney at County Courthouse, , Montana, in accordance with the times and dates set forth in the affidavit accompanying this order and signed herein by County Attorney, and the Clerk of this Court is directed to issue subpoenas to such persons in accordance with such dates and times. The persons to be subpoenaed, and to be questioned before , regarding their actual knowledge of what precipitated, caused, and was involved in that not all of their accounts as to what occurred prior to, during, and after regarding that such disagreement might be due to poor memory of or a deliberate attempt by one or more of the said witness(es) to refuse to cooperate with the investigation and the investigative authorities for reasons of his, her, or their own; that other witnesses to the times and events mentioned herein may be deliberately attempting to avoid being questioned or involved in the investigative process; that all of these witnesses, as are known at this time, together with their addresses, are listed hereinafter; that the evidence they could offer and provide is definitely material to the proper investigation of this offense; that some of these witnesses are believed to be reluctant in cooperating with the authorities in the investigative process insofar as is known at this point are involved in the offense only as witnessesand not as active participants in the commission of the offense: that the office of the County Attorney has a duty to assist the law enforcement agencies of this county and city of in the investigation into this offense; that all of the information gathered at this point may or may not be absolutely correct; which may be due to the reluctance of some of the said witnesses to give evidence, or due to the ordinary frailties of the memory of some witnesses, and, due to the enormity of the offense and the necessity for the questioning, under oath and with the assistance of certified reporter, it is respectfully requested that this court issue its order directing subpoenas to be issued to the said persons to appear in the building, room, and at the times specified in each subpoena, and there to be questioned and their testimony recorded under oath in each instance.
